Terms of Service
Last Updated:
Effective Date: August 5, 2026
Welcome to Fourcast. These Terms of Service ("Terms") are a binding agreement between you and PoolZen LLC, a Kentucky limited liability company doing business as Fourcast ("Fourcast," "we," "us"), governing your use of the Fourcast mobile application, the website at fourcast-app.com, and all related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What Fourcast Is — and Is Not
Fourcast is a golf group coordination and scorekeeping application. It helps groups organize rounds, enter scores, track standings, and maintain an informal record ("ledger") of the results of side games played among group members.
Fourcast is a scorekeeping and entertainment tool only. It is not a gambling service, wagering platform, payment service, or financial institution.
The Service never holds, transfers, processes, or settles money. Ledger entries are informational records only — like a scorecard or notebook.
Fourcast is not a party to any game, wager, or arrangement between users, and makes no representation that any such arrangement is enforceable.
Any settlement between users happens entirely outside the Service, at users' sole discretion and risk.
Fourcast charges no fee, commission, or rake on any game or ledger amount. Subscription fees are for software features only and are unrelated to any ledger amount.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and legally able to enter this agreement.
3. Your Responsibility for Games and Local Law
You are solely responsible for ensuring that any game, side game, or arrangement you record in the Service is lawful in the jurisdiction where it is played. Laws regarding social games vary by state and locality. You represent and warrant that your use of the Service complies with all applicable laws. Fourcast has no obligation to monitor ledger entries and no ability to determine the legality of your games. If social wagering is not lawful where you play, use the Service for scorekeeping only.
4. Accounts
You are responsible for your account and for keeping your login method (Google account or email) secure. You must provide accurate information. You may delete your account at any time in the app (Profile → Delete Account) or by emailing support@fourcast-app.com; deletion permanently removes your account and associated personal data as described in the Privacy Policy.
5. Subscriptions and Payment
Parts of the Service are free. Premium features require a paid subscription.
Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled.
Purchases through Apple or Google are billed and managed by them; cancel in your device's subscription settings. Their refund policies apply.
Purchases on our website are billed through our payment processor. You may cancel at any time online — cancellation is as simple as signing up and takes effect at the end of the current billing period. For annual plans, we will send a renewal reminder before each renewal as required by applicable law.
Prices may change; we will give notice before a change affects an existing subscription, and continued use after renewal constitutes acceptance.
Except where required by law or by platform policy, payments are non-refundable.
A subscription may unlock premium features for a group you belong to. Group-level access depends on at least one group member maintaining an active subscription and may change if that subscription lapses.
6. User Content
You may submit content such as group names, photos, messages, and scores ("User Content"). You retain ownership of your User Content. You grant Fourcast a non-exclusive, worldwide, royalty-free license to host, display, and process User Content solely to operate and improve the Service. You represent you have the rights to what you post, and you agree not to post content that is unlawful, infringing, or abusive.
Copyright. We respond to copyright notices sent to support@fourcast-app.com.
7. Acceptable Use
You agree not to: (a) use the Service for real-money gambling operations, bookmaking, or any commercial wagering enterprise; (b) scrape, reverse engineer, or access the Service by automated means; (c) interfere with the Service or other users; (d) impersonate others; (e) use the Service in violation of law.
8. Handicap Data
Handicap information in the Service is entered by users. Fourcast does not guarantee the accuracy of handicap data and is not affiliated with or endorsed by the USGA.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SCORES, STANDINGS, LEDGER AMOUNTS, OR WEATHER INFORMATION WILL BE ACCURATE. YOU USE OUTPUTS OF THE SERVICE AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) FOURCAST IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL; (b) FOURCAST IS NOT LIABLE FOR ANY DISPUTE, LOSS, OR OBLIGATION ARISING FROM ANY GAME, WAGER, LEDGER ENTRY, OR SETTLEMENT BETWEEN USERS; AND (c) FOURCAST'S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent permitted.
11. Indemnification
You will indemnify and hold Fourcast harmless from claims arising out of your User Content, your games or settlements with other users, or your violation of these Terms or applicable law.
12. Dispute Resolution — Arbitration and Class Action Waiver
Please read this section carefully — it affects your legal rights.
Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. The arbitration will be held in Jefferson County, Kentucky or remotely by videoconference. You and Fourcast each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@fourcast-app.com with the subject "Arbitration Opt-Out."
13. Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate accounts that violate these Terms. Sections 1, 3, and 9–12 survive termination.
14. Apple App Store Terms
If you downloaded the app from the Apple App Store: these Terms are between you and Fourcast, not Apple; Apple has no obligation to provide support or maintenance; Apple is not responsible for any product claims; and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
15. General
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. If any provision is unenforceable, the rest remains in effect. These Terms plus the Privacy Policy are the entire agreement. We may update these Terms; material changes will be notified in the app or by email, and continued use after the effective date constitutes acceptance.
